Terms of Service

These Terms of Service ("Terms") govern your use of PingWatchdog ("the Service"), operated by Phillip Wilson ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

PingWatchdog provides uptime monitoring for websites, APIs, and servers. We check your endpoints at the interval corresponding to your plan and notify you when they become unreachable or return errors.

We strive for reliable monitoring but do not guarantee uninterrupted or error-free operation of the Service itself. The Service is provided on an "as is" and "as available" basis.

2. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

You must be at least 16 years old to use the Service.

3. Acceptable Use

You agree not to:

• Use the Service to monitor endpoints you do not own or have authorization to monitor
• Use the Service for any unlawful purpose or in violation of any applicable laws
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to the Service or its systems
• Resell or redistribute the Service without our written permission
• Use the Service to monitor illegal content or services

We reserve the right to suspend or terminate accounts that violate these terms.

4. Payment and Billing

Paid plans are billed monthly or annually in advance. Prices are listed on our Pricing page and are subject to change with 30 days' notice. Price changes do not affect your current billing period.

You are responsible for providing valid payment information. Failed payments may result in suspension or downgrade of your account to the Free plan.

All prices are exclusive of VAT and other applicable taxes, which will be added where required.

5. Cancellation and Termination

You may cancel your paid plan at any time. Your Service continues until the end of your current billing period. No refunds are issued for partial months, except as required by law (see our Refund Policy).

Upon cancellation, your account reverts to the Free plan. Data beyond the Free plan's retention limits may be deleted after the retention period expires.

We may terminate or suspend your account for violation of these Terms, with or without notice. In such cases, no refund will be provided.

6. Intellectual Property

The Service, including its code, design, branding, and documentation, is owned by Phillip Wilson and protected by copyright and other intellectual property laws. These Terms do not grant you any right to our intellectual property beyond the limited right to use the Service as described herein.

Any feedback, suggestions, or ideas you provide about the Service may be used by us without restriction or compensation.

7. Limitation of Liability

To the maximum extent permitted by law, Nous Research shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim. For Free plan users, our liability is limited to €50.

8. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to the data practices described therein.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.

For EU consumers, this does not affect your rights under the mandatory consumer protection laws of your country of residence.
